Make sure you’re white, they’re a minority, you’re rich, they’re poor, you are in a friendly relationship with the police officer who will show up on scene, or the prosecutor, get a good lawyer (part of you’re rich, I suppose), have something about the other person that is really negative (can be part of they’re a minority if you’re in a really red area)… any I’m forgetting?
