The Controlled Substance Act, the relevant law, does not specifically name it. It specifies substances with no medical use go on the Schedule 1 list. The Attorney General under Nixon ordered it to be placed there with no factual relation to it meeting the criteria. The President absolutely could sign an order for the AG to retract that order on the basis of it not being a legal order to begin with.
