They are a lemmy instance dedicated to the facilitation of piracy, and copyright infringement in general which is illegal. It is by nature in violation of the rules of your instance which prohibit illegal content, therefore it is imperative that you defederate it in accordance with your policies.
Torrent files also aren’t illegal.
Also, you’re on the internet, which isn’t beholden solely to US copyright laws, so unless you’re a lawyer who specializes in international copyright law, I doubt you can speak with any certainty to the legality of post content in every jurisdiction across the globe.
Here’s an idea: if you don’t want to see that content, block the community.
They are illegal when they contain copyrighted material like games or movies, which is what those contain, they literally say it.
