As there have been lots of questions about the legality to run a tenfingers node, I dived deep into the legal protections we have here in the EU, and it is called Safe Harbour Provision.
I’m not a lawyer, all help greatly appreciated! I thought that as the node do not know what it is sharing (because it is encrypted), it falls under the same legislation as internet broadband providers, but even website hosters benefit from this protection. If anyone is aware about the details about similar laws outside the EU, I’d be grateful if you can share them with me.
So you can spin up a tenfingers server node, but it obvious comes with a caveat ; there must be a way to generate takedown requests, and as a node owner, if you get one, you must comply. Much like a website.
You can now generate a takedown request from a link file, it is a simple command line and it generates a takedown file and an address file containing all the nodes carrying the data. All you have to do is to distribute the takedown request with the added takedown file to the users of the IP addresses. This is done all the time with illegal content.
If you, as a node owner, gets a takedown request you just need to execute it with a simple command to comply.

Curious… what’s to prevent a malicious actor from generating a takedown request to wipe someone’s data? I mean presumably if I’m sharing my data I know it’s legal and have no concern. But if someone creates a takedown request, all nodes, including my own, will honor it correct? It seems like there should be both some delay - for review and possible cancelation - and an option for the content owner to block the delete outright on their own machine.
Okay, so say you share your fantastic holiday film with all the rights needed, and a bad actor thinks it would be fun to do a “take down” because it’s so successful!
First of all, if you only share with friends, the bad actor will never know, so I’m assuming you posted your link on a public forum for example.
So he’s got his hands on the link, extracts the IP adresses (with the inbuilt takedown tool), and also he has a friend in the telecom industry who illegally (I think it is not legal in most countries) gets him the owners and emails of said ip adresses.
He sends out the takedown requests and everyone accepts the request and removes your data from their systems without thinking more about it, it’s simple and inbuilt in the system and you just executes the takedown request you got and the data is purged. Better safe than sorry, I mean they don’t know what it is!
So what happens now?
As you didn’t take down your own legal data, your server will see that the nodes sharing your data are no longer sharing it (regular verification) and proceeds to dump the data they shared for them. As there are not enough sharing now, the server reaches out and shares with someone else.
The anti decay links are updated, pushed, and people can continue to see your fantastic holidays.
